This lecture discusses the significance of buy-sell agreements in business succession planning. We will discuss background info on Buy-Sell agreements, as well as the impact of the recent Supreme Court decision in Connelly v. United States.06,06,24. This decision disrupts current assumptions about the estate tax implications of life insurance funding shareholder buy-sell agreements. All buy-sell agreements and insurance premiums should be reviewed to maximize their value and maintain their tax efficiency.

About the Webinar:

Life insurance policies are complex and often misunderstood financial instruments that require active management by the policy owners. 

These same individuals have plans for reviewing and managing other types of assets, such as stocks, bonds, and real estate, but rarely review or conduct proper management of their life insurance. 

An owner/trustee may be an individual, (usually the eldest sibling, that knows very little about trusts or life Insurance), or an institutional trustee. Both of these trustees serve in a fiduciary capacity and are legally liable to protect the interests of the trust’s beneficiaries and manage the trust assets for their benefit.

In the near future, (2025), trust planning & trustee guidance will become more in demand as the estate tax exemption will be reduced from $11 million to approximately $5,600,000.

I am honored to have been asked to speak on a topic I am passionate about for ProLawCLE. My presentation, “Considerations Regarding Trust Owner & Individual Life Insurance,” will cover important information that advisors and amateur trustees need to know to protect the underlying structure of their clients’ trusts as well as their individually owned life insurance policies.
